1. Scope
These terms and conditions of participation shall apply to the “Join us on our mission” fundraising campaign run by PARI GmbH Spezialisten für effektive Inhalation, Moosstrasse 3, 82319 Starnberg (“PARI”).

2. Participants
2.1. All authorised participants are natural persons (represented by their legal representative where applicable).

3. Rights and obligations
3.1 By ordering a PARI t-shirt, the participant undertakes to participate in the “Join us on our mission” fundraising campaign as described below and to provide PARI with a photo showing one or several participants wearing the t-shirts at a public sporting event or mastering a personal sport challenge. We define a public sporting event as a scheduled temporary event everyone has access to and therefore participants are not exclusively from a certain group of people. The shirts will be sent for this purpose only.
3.2 On completion of the ordering process (see section 4), PARI shall arrange the free delivery of the t-shirts. A maximum of two t-shirts may be ordered per household. Delivery will take place while stocks last.
3.3 The participant shall participate in a public sporting event or master its personal sports challenge, where he/she shall wear the t-shirt sent by PARI. Whether this is a running, cycling or any other public sporting event is irrelevant.
3.4 The participant shall take a photograph of him/herself or of several participants wearing the PARI t-shirts at the sporting event or his personal sports challenge and shall make this photo available to PARI, with further information if desired (e.g., about the sporting event or his challenge, about him/herself, his/her motivation etc.) via the channels described.
3.5 The participant shall post his/her photo to the PARI BOY Facebook channel or shall e-mail it to joinus@pari.com. By posting or emailing the photo, the participant grants consent to PARI to share the photo on the Facebook channel and to use it as part of the 50th anniversary of PARI BOY. It may be used online, on social media or in print media (such as flyers, brochures, advertisements).
3.6 By posting or emailing the photo, the participant confirms (a) that he/she is the owner of the photo or else is authorised to dispose of the rights to the photo, and that the use described in 3.5 above does not conflict with any rights of third parties, and (b) that he/she permits PARI the use described in 3.5 above and grants the necessary exclusive licence to the usage rights. Names or other personal data sent by the participant with the t-shirt order will not be published, but will be used for delivery only and will not be passed on to third parties.
3.7 For each contribution in 2018, PARI will donate EUR 10.00 either to British Lung Foundation, Cystic Fibrosis New Zealand, Cystic Fibrosis Australia or ECFS (Euopean Cystic Fibrosis Society) Once the participant has sent his/her photo, PARI will add 10€ per person to the donation sum. The sum donated per photo is limited to a maximum of EUR 100.00. Any participant may participate in several events and inform PARI by sending photos. PARI will make a new donation for every photo e-mailed or posted. PARI reserves the right not to publish photos, particularly if they do not comply with the requirements described here, contain unlawful or objectionable content or give rise to the fear that the rights of third parties have been breached.
3.8 The donation amount will be finalised at the end of 2018. The participant may indicate which organisation should benefit only when ordering the t-shirt. There will be no direct allocation of donations raised by the participant; rather the entire sum will be donated to the organisations in proportion to the number of clicks at the end of the campaign.

4. Ordering process and conclusion of contract
4.1. The participant may choose from the PARI t-shirt range (size, sex) and save them (a maximum of two t-shirts per household, collective orders will not be accepted) in the cart by clicking the button [add to cart]. The products selected may be changed, e.g., deleted, within the cart. In addition, the participant can choose which organisation should receive the donation. The participant then completes the ordering process by clicking on the [NEXT] button.
4.2. By clicking the button [order now free of charge], the participant submits a binding request to order the goods in the cart and to participate in the campaign. Before submitting the order, the participant may change the details at any time, or view it by clicking the “back” button on the browser to return to the cart or cancel the entire order. Required fields are indicated with an asterisk (*).
4.3. PARI will then send an automatic confirmation email to the participant, detailing the participant’s order again, which the participant can print by using the “print” function (order confirmation). The automatic confirmation merely documents that the seller has received the participant’s order and does not constitute acceptance of the request. The contract will be concluded only when the seller sends the products ordered, if available, to the participants.
4.4 The t-shirts will be sent to the participant free of charge.

5. Delivery, availability of goods
5.1. If delivery of goods fails on three occasions through the fault of the participant, PARI may withdraw from the contract.
5.2. The Contributor campaign shall run only while t-shirt stocks last. If the product ordered is no longer available, PARI will inform the participant immediately.

6. Reservation of ownership
The t-shirts will remain the property of PARI until the photos have been sent (see 3.6 above).

7. Liability
7.1. The following limitations and exclusions of liability shall apply to PARI’s liability for damage without prejudice to any other statutory eligibility criteria.
7.2. Where damage is caused by intent or gross negligence, PARI is fully liable.
7.3. Furthermore, PARI is liable for any minor negligent breach of essential duties, the violation of which endangers the purpose of the contract, and for the breach of those duties whose fulfillment would enable the proper implementation of the contract and where participants regularly rely on compliance therewith. In such a case, however, PARI shall be liable only for foreseeable, contract-typical damage. PARI shall not be liable for any minor negligent breach of obligations referred to in the preceding sentences.
7.4. The foregoing limitations to liability shall not apply in the event of loss of life, physical injury or damage to health. Liability under the German Product Liability Act shall remain unaffected.
7.5. Insofar as the seller’s liability is limited or excluded, this shall also apply to the personal liability of employees, representatives and vicarious agents.
7.6 European Commission platform for Online Dispute Resolution (ODR) for consumers: http://ec.europa.eu/consumers/odr/. We are neither willing nor required to participate in dispute resolution proceedings before any consumer arbitration body.

8. Storage of the contract text
8.1. The participant can print the contract text before submitting the order to PARI by using the “print” function in his/her browser.
8.2. In addition, PARI will send the participant an order confirmation containing all the order details to the e-mail address supplied by him/her. The participant will also receive a copy of the Terms and Conditions of Participation and withdrawal policy with the order confirmation. We will, in addition, save the contract text, but will not make it available on the internet.
